Irvington, NJ Fence Regulations: Height Limits (2026)

Township Code § 294-5A sets a two-tier height limit for residential fences: no more than four feet above ground level when the fence sits closer to the street than the district's front setback line, and no more than six feet once it sits at or behind that line. An exception lets perimeter fencing around apartment complexes of 500 or more contiguous units reach eight feet either way, reflecting the section's stated security rationale. Nonresidential fences get more room: § 294-5B caps B-1 and B-2 Business District fences at eight feet, though the site-plan approving agency can waive that limit for safety, security or screening reasons, and § 294-5C allows fences up to ten feet in the M-1, M-2 and O-1 Districts.

Where two adjacent lots sit at different grades, § 294-5D measures the fence's permitted height from the higher lot's ground level. Separately, corner lots face a visibility restriction under Chapter 650's restrictions section: no hedge, fence or wall taller than three feet above curb level, other than a single post or tree, may stand inside the sight triangle formed by the intersecting street lines and a line ten feet from the intersection.
