Irvington, NJ Short-Term Rentals: Short-Term Rental Permits (2026)

Chapter 510, Short-Term Rentals, adopted 5-22-2023 by Ord. No. MC 3824, does not create a licensing or permitting pathway for short stays; it prohibits them. Section 510-2A bars renting any dwelling house, apartment, rooming house, boarding house or room for a term of less than 30 days, with duly licensed hotels and motels as the only carve-out. Section 510-2B goes further and makes it unlawful for an owner, lessor, sublessor, agent or anyone acting in concert with them to receive any consideration, meaning rent, fees or any thing of value, for occupancy under 30 days, and the definition of DWELLING UNIT in Section 510-1 explicitly reaches accessory buildings and structures, including a vehicle parked on the property.

Section 510-4 separately bans advertising a rental in violation of the chapter. Two narrow paths remain lawful: Section 510-3 permits a housekeeping-unit member, such as a house guest, to stay under 30 days without consideration, and Section 510-2D lets an existing tenant continue on a month-to-month basis after a lease of at least six months. Enforcement falls to the Building Code Official, Fire Official, Health Department, other code officials, or Township legal counsel under Section 510-5A, and the Municipal Council has declared any violation a public nuisance and nuisance per se under Section 510-5B.
