Under FS 509.032(7)(b), a local government may impose maximum occupancy on vacation rentals only if the rule applies uniformly to all residential properties. Pinellas Park has not adopted its own STR occupancy ordinance, so hosts default to the Florida Building Code occupancy guidance and any applicable Pinellas County STR Certificate of Use rules. County Ordinance 25-15, applicable in unincorporated areas, sets occupancy at no more than two persons per bedroom plus two persons in a common area, not to exceed ten total. Hosts are encouraged to use this ratio as best practice and to comply with any HOA or insurance limits.
Exceeding occupancy may trigger county code enforcement, building safety violations, and DBPR complaints; insurance and HOA penalties may also apply.
