Montgomery County Code Chapter 54, as amended by Bill 22-23, sets clear occupancy limits for short-term residential rentals. The maximum number of adults age 18 and older is six per property. The maximum number of adults per bedroom is two. Children are not counted toward these caps but the total occupancy must still comply with building and fire safety codes. Only the primary residence of the property owner may be licensed as a short-term rental. Accessory Dwelling Units (ADUs) are explicitly excluded and may not be used as short-term rentals. The property must be the principal residence of the licensee, meaning the licensee lives there for the majority of the year. These occupancy limits are designed to maintain residential neighborhood character and prevent de facto hotel operations in residential zones. Hosts must accurately represent the maximum occupancy in their listing. Overloading a rental beyond these limits can result in license action.
Exceeding occupancy limits is a Class A civil violation under Chapter 54, carrying a fine of up to $1,000 per offense. Repeated overcrowding can result in license revocation.
