Under Visalia Municipal Code Section 17.32.166, adopted by the City Council on October 16, 2023, the owner shall limit occupancy of a short-term rental to two persons per bedroom plus one additional person. STR use is restricted to the habitable interior portions of a primary dwelling - garages, tents, camper trailers, recreational vehicles, accessory dwelling units (ADUs), and other exterior structures or spaces are not permissible as a short-term rental or as bedrooms within a short-term rental unit. Only one short-term rental unit is permitted per parcel in any residentially zoned district, and a maximum of 2 guest rooms may be rented out within the primary residence. Operators must also maintain a Transient Occupancy Tax (TOT) certificate and remit the city's 10% TOT on stays of 30 nights or fewer. Permits are issued by the Community Development Department.
Operating without an STR permit, exceeding the 2-per-bedroom-plus-1 cap, renting more than 2 guest rooms, renting an ADU or non-primary residence, or using a garage, RV, or other exterior space as STR sleeping area is a violation of MC 17.32.166 and subjects the operator to administrative citations, code enforcement, and revocation of the STR permit.
