Summary

A Loudoun County short-term rental must provide 1 off-street parking space beyond whatever the dwelling already requires under Section 7.06, on-street parking normally doesn't count, and the Zoning Administrator can only relax the requirement for documented lot-size, environmental, or accessibility constraints.

These county ordinances apply to unincorporated areas of Loudoun County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Parking Requirement. In addition to the off-street parking spaces required for the existing Dwelling Unit(s) and any other uses on the parcel pursuant to Section 7.06, 1 off-street parking space must be provided. The Zoning Administrator may modify the parking requirements of this section if the Operator can demonstrate that the requirements of this section cannot be met because of: The exceptional size and/or shape of the lot; Environmental or engineering constraints on the lot; Special accessibility needs; or Other extraordinary situations or conditions of the lot. On-street parking does not count toward the required parking unless specifically requested and approved pursuant to Section 4.03.05.B.6.b.

Full Breakdown

06. The Zoning Administrator has narrow discretion to modify that requirement, but only where the operator demonstrates one of four specific constraints: the exceptional size or shape of the lot, environmental or engineering constraints, special accessibility needs, or other extraordinary lot conditions, and any modification granted can carry conditions to keep the outcome consistent with the section's purpose. b. 4 requires 'a drawing that shows the location of the Dwelling Unit(s) being rented and the required parking on the parcel' before the permit can be approved, so the parking layout is locked in at permitting rather than left to be worked out later.

Violations & Fines

Because the extra parking space is a Zoning Permit condition, failing to provide or maintain it is a zoning violation the Zoning Administrator can cite, and, per Chapter 12's definition of a 'Short Term, Recurring Zoning Violation,' which lists 'parking of vehicles on an unpaved surface' among its examples, recurring parking non-compliance at a rental can be treated as a day-by-day violation rather than a single incident, increasing exposure the longer it continues uncorrected.

Frequently Asked Questions

How much extra parking does a short-term rental need beyond the house's normal requirement?
One additional off-street parking space, required by Section 4.03.05.B.6.a (or C.6.a for a residential-accessory rental), on top of whatever off-street parking the dwelling and any other uses on the parcel already need under Section 7.06.
Can I count street parking in front of my house toward the requirement?
Generally no. Section 4.03.05.B.6.c says on-street parking doesn't count toward the required parking 'unless specifically requested and approved' by the Zoning Administrator under Section 4.03.05.B.6.b, so you need affirmative approval, not just an available curb space.
What if my lot is too small or oddly shaped to fit the extra space?
The Zoning Administrator may modify the parking requirement if you demonstrate the lot's exceptional size or shape, environmental or engineering constraints, special accessibility needs, or another extraordinary condition, and may attach conditions to any approved modification.
