Chapter 239, Article III of the Bergenfield Code (adopted September 4, 2018 by Ordinance 18-2533) prohibits short-term rental property uses, including the marketing or solicitation of such rentals through online platforms, classified ads, or other media. Lawful occupancy requires a rental term of more than 30 days. House guests of the owner staying 30 days or less without consideration are permitted. Because STRs are prohibited rather than regulated, the Borough does not issue STR permits, and Airbnb or VRBO-style listings are not allowed in any zoning district.
Each day of unlawful short-term rental use is a separate violation, with civil penalties up to $1,250 per violation, plus injunction, attorney's fees, and zoning enforcement.
