Summary

Sandoval County's zoning code lists 'Short Term Rentals' as a permissive, by-right use in the Rural Residential/Agricultural (RRA) District, the zoning that covers most of the unincorporated county, so an STR host there doesn't need a conditional-use permit or zoning hearing the way a bed-and-breakfast does.

These county ordinances apply to unincorporated areas of Sandoval County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Full Breakdown

Sandoval County's Comprehensive Zoning Ordinance defines a 'Short Term Rental' as a leased or rented single-family residence, or a unit within a multifamily building, rented in whole or in part for 29 days or less per lease period where no food service is provided, a category that includes a Guest House or In-Law Quarters used that way (§ 6(B)(66)). Item 9 of the RRA District's permissive-use list names 'Short Term Rentals' directly alongside a singular dwelling unit, a guest house, accessory uses, agricultural activities and home occupations, meaning an STR requires no Zoning Commission review, public hearing or conditional-use approval to operate (§ 9(1)).

That treatment differs from a traditional Bed and Breakfast, which the same section lists as a conditional use requiring Zoning Commission review and approval. District standards still apply to any STR structure: residential buildings in the RRA District need a front setback of at least 20 feet and side and rear setbacks of at least 10 feet (§ 9(1)(D)). All territory that later comes within the county's zoning jurisdiction is automatically classified RRA until reclassified, so the by-right STR allowance reaches broadly across the unincorporated county (§ 3(B)).

An STR operator must separately register as a vendor and collect the county's five percent lodger's tax under Chapter 36, Article V, but that tax registration is distinct from, and does not substitute for, the zoning classification described here.

Violations & Fines

Operating an STR use that is not actually permissive there, for instance in a Community District or Overlay Zone whose use list departs from the RRA list, without the required conditional-use or zone-map approval is a zoning violation: the Zoning Officer can issue written notice, allow 30 days to cure, and follow with a civil citation carrying a fine of up to $300 that can become a property lien (§§ 15(F), 24). Failing to collect and remit the county's lodger's tax is a separate violation under § 36-97.

Frequently Asked Questions

Do I need a zoning permit to run a short-term rental in Sandoval County?
In the RRA (Rural Residential/Agricultural) District, which covers most of unincorporated Sandoval County, 'Short Term Rentals' are listed as a permissive use under § 9(1), so no conditional-use permit or Zoning Commission hearing is required. You still need the county's lodger's tax license under Chapter 36.
What's the difference between a short-term rental and a bed and breakfast under county zoning?
Short-Term Rentals are a permissive, by-right use in the RRA District, while a Bed and Breakfast is listed as a conditional use requiring Zoning Commission review and approval under the same § 9(1). A short-term rental provides no food service; a bed and breakfast does.
Are there setback rules for a short-term rental property?
Yes. Even though STRs need no separate zoning permit, the RRA District's general standards still apply: residential structures need at least a 20-foot front setback and 10-foot side and rear setbacks under § 9(1)(D). Those setbacks run from the road right-of-way or lot boundary line to the structure.
