Short-term rental permit rules in Sioux Falls, SD — also called Airbnb permits, vacation rental licenses, or STR registration — list the application steps, fees, and operating requirements for hosting.
Effective January 1, 2024, every short-term rental in Sioux Falls must hold a city Residential Rental Permit ($50/year as of July 1, 2024) issued by Planning and Development Services under Sioux Falls Code §150.177, plus a South Dakota sales tax license and a South Dakota Department of Health lodging license under SDCL Chapter 34-18.
Sioux Falls adopted its first comprehensive rental-permit ordinance in 2023 (effective January 1, 2024), and the program covers both long-term rentals and short-term/vacation rentals. Under Sioux Falls Code §150.177, the property owner or manager must (1) apply for a Residential Rental Permit through Planning and Development Services, (2) complete two hours of city-approved landlord training (either the South Dakota Multi-Housing Association online course or the City Attorney/Planning Department in-person course), (3) provide and keep current contact information for the owner and any on-site manager, and (4) for short-term rentals only, file proof of (a) a South Dakota sales tax license from the Department of Revenue and (b) a South Dakota Department of Health lodging license under SDCL Chapter 34-18 (public lodging establishments). The permit fee is $50 per address per year beginning July 1, 2024 (the city waived fees during the first six-month onboarding window). The fee is waived for newly constructed buildings prior to first occupancy, and a transferring landlord who notifies the city within 30 days of a sale/transfer can move the permit to the new owner without re-paying. Per §159.303 the property must also register with the State of South Dakota as a vacation home, and the owner/manager contact must be on file with Planning and Development Services. If the owner resides more than 50 miles from Sioux Falls city limits, the application must list a separate local contact within 50 miles who is authorized to handle property upkeep and respond to complaints. Sioux Falls does not impose a separate STR-only application fee on top of the $50 rental permit fee — the same permit covers both rental classes, with the STR-specific add-ons being the state-license proofs and the §159.303 zoning conditions (see registration-rules subcategory).
Operating without a Residential Rental Permit after July 1, 2024 exposes the owner to misdemeanor charges under Sioux Falls Code Chapter 150 (Rental Housing) and city general-penalty provisions; the program adopted criminal penalty enforcement effective July 1, 2024 after a six-month soft-enforcement window. The permit is subject to revocation under §159.303 after four citations for ordinance violations. Operating an STR without a South Dakota Department of Revenue sales tax license is a misdemeanor under SDCL Chapter 10-45, and operating without a state Department of Health lodging license violates SDCL Chapter 34-18 and exposes the operator to administrative civil penalties and an order to cease lodging operations.
