Orange County regulates short-term rentals in its unincorporated territory through Zoning Code Section 7-9-93, part of the County's Comprehensive Zoning Code. The section defines a short-term rental as 'a rental of all or any part of a dwelling unit to a person(s) as lodging for a period of less than thirty (30) days.' Operating without a permit is prohibited. The County says its stated purpose is to avoid impacts to traffic, noise, parking and a neighborhood's residential character. Per Section 7-9-93(d), short-term rentals are permitted, subject to a Short-Term Rental Permit issued by the Director, in: (1) single-family dwelling units within single-family residential districts or designated single-family areas; (2) multifamily residential districts or designated multifamily areas; and (3) commercial districts within a previously approved residential dwelling unit. The section applies to all unincorporated areas, including planned community and specific plan areas. Accessory Dwelling Units (ADUs) are expressly barred from short-term rental use. Applicants apply through myOCeServices.ocgov.com and submit a letter describing the proposed use and operation, a floorplan of the residence, a blank lease agreement, and proof of ownership. The application fee is reported at $250. Permits are issued by, and must meet performance standards reviewed by, the OC Development Services Director. The County notes that a change in ownership terminates the permit.
Operating a short-term rental without an approved permit, or after a permit is revoked, violates Section 7-9-93. Two violations related to the ordinance can discontinue short-term rental operations for up to one year. The County's transient occupancy tax page and zoning provisions are enforced by OC Development Services and the Treasurer-Tax Collector.
