Lodi does not require an STR to be the operator's primary residence. Both owner-occupied and non-owner-occupied (investor) STRs are allowed, subject only to the Home Occupation Permit and TOT registration.
Lodi Municipal Code contains no provision restricting short-term rentals to a host's primary residence. The Home Occupation Permit standards in LMC §17.36.060 require that the home occupation be 'clearly secondary to the full-time use of the property as a residence' and that activity be confined to one room not exceeding 25% of ground-floor area — language that arguably applies poorly to whole-home STRs but the city has historically treated STR hosts as home occupations regardless. Lodi News (March 2024) reported that Mayor Lisa Craig and city planners explicitly discussed 'whether there be requirements that short-term rentals be locally owned' as a possible future zoning amendment — confirming that no such requirement currently exists. Compare to Sonoma, which the same article notes has a strict no-new-STR cap. Statewide, AB 1482 (Tenant Protection Act) does not regulate STR ownership; California has no state primary-residence mandate for STRs.
Because no primary-residence requirement exists, there is no direct violation. Non-resident operators must still maintain a Home Occupation Permit, register for TOT, and ensure the property complies with LMC §17.36.060 standards (no nuisance, no exterior modifications, no on-site non-resident employees).
