Summary

Any private cut, excavation, crossing, or facility installed in a parish road right-of-way in Ouachita Parish needs a permit from the director of public works under Code Sec. 19-4. Contractors post a cash or surety deposit sized to the work: $10 per square foot for cutting, $0.50 per linear foot for installed facilities, plus $100 for boring or jacking under the roadway. The deposit returns only after the director confirms the surface is properly restored.

These county ordinances apply to unincorporated areas of Ouachita Parish. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(b)Permit required. No person, firm or corporation, or agent thereof shall make any cuttings across any parish street or road, or erect, construct, and install any facility in, on, or about the right-of-way of any parish street or road without having first obtained a permit thereof from the director of public works, or his designee. No person, firm or corporation, or agent thereof, shall engage in any activity in connection with any construction in, or upon the rights-of-way of the parish roads, or streets without first obtaining a permit from Ouachita Parish, even though a franchise has been previously granted.

Full Breakdown

Section 19-4 of the Ouachita Parish Code governs every cut, crossing, or facility placed in, on, or about a parish street or road right-of-way, whether for a utility line, a driveway culvert tie-in, or any other private encroachment. Subsection (b) requires a permit from the director of public works or a designee before any cutting, and bars construction in the right-of-way even when the applicant already holds a franchise. Work that touches the traveled surface or shoulder, such as a bridge, culvert, or crossing over a parish ditch or canal, needs a separate special permit under subsection (c) and must follow the director's rules and specifications.

Every applicant deposits security with the parish secretary-treasurer before work starts: $10.00 per square foot for cutting a street or road, $0.50 per linear foot for facilities installed within the right-of-way, and an added $100.00 for boring or jacking beneath the right-of-way (subsection (d)). The deposit can be cash, a cashier's or certified check, or a bond, and it is returned only after the director approves the restoration work.

Applications go to the director of public works in writing, describing the work, the reason for it, and the estimated time needed, backed by plans showing the material quantities involved (subsection (e)). Once work is done, the permittee must restore the road, street, or right-of-way to its prior condition within the permit's time limit (subsection (h)); if restoration is not completed, the parish can do the work itself and bill the permit holder (subsection (i)). Overhead aerial utility crossings are exempt from the permit and deposit rules if their supporting structures sit outside the right-of-way or no more than six feet inside it (subsection (m)).

Violations & Fines

Violating any part of Sec. 19-4, including failing to complete the required restoration, is a misdemeanor under subsection (p). A conviction carries a fine of up to $500.00, up to 30 days in jail, or both. The parish can also recover its own restoration costs by invoicing the responsible person, firm, or corporation directly under subsection (i), separate from any criminal penalty.

Frequently Asked Questions

Do I need a permit to run a utility line along a parish road?
Yes. Section 19-4(b) requires a permit from the Ouachita Parish director of public works before anyone erects, constructs, or installs any facility in, on, or about a parish road right-of-way, even if you already hold a franchise to operate in the parish. Working without the permit exposes you to the section's misdemeanor penalty.
How much money do I have to put down before I start work?
It depends on the work: $10.00 per square foot for cutting a parish street or road, $0.50 per linear foot for installing a facility within the right-of-way, and an extra $100.00 if you are boring or jacking beneath the roadway. You can post it as cash, a certified check, or a bond.
What happens if I do not restore the road after the work is done?
The parish can perform the restoration itself and bill you for the cost under subsection (i), and your failure to restore is itself a violation under subsection (h) and (p), punishable by up to a $500 fine or 30 days in jail.
Does a franchise from the parish let me skip the permit?
No. Subsection (b) specifically states a permit is required for construction in parish rights-of-way even though a franchise has been previously granted, so franchise holders still have to apply for each job.
