Dayton, OH Sidewalk & Pedestrian Rules: Encroachment Permits (2026)

The following licenses and privileges in streets, sidewalks, sidewalk spaces, alleys, or public ways or places, by reasons of their inherent nature or duration are hereby declared and defined to be "special licenses and privileges" and use thereof may be issued by the Director of Public Works in the manner hereinafter set forth upon the payment of the following enumerated fees:

(A)Areaway under a sidewalk, a cellar door, ventilating grate or other sidewalk opening, $5.00 per square foot and in no case less than $200.00.(B)Overhead bridge, conveyor tunnel or other structure of like nature, $2.00 per square foot, and in no case less than $200.00.(C)Tank, vault, or other underground receptacle greater than 72 square feet in floor area, $7.68 per square foot, and in no case less than $768.00.(D)Building encroachments above or below ground, $5.00 per square foot. Each type encroachment and each public way figured separately, in no case less than $200.00.(E)Retaining walls, steps, ramps, planter boxes, or the private use of land areas, $1.00 per square foot, but in no case less than $200.00.(F)Any canvas awning, canopy, sign or similar structure supported within a street or alley right-of-way, $200.00.(G)Well (Water Extraction Well), $200.00. The special licenses and privileges in the streets also require a construction permit prior to the construction or installation where excavation is involved.
