West Allis, WI Sidewalk & Pedestrian Rules: Encroachment Permits (2026)

Revised Municipal Code § 11.031 bars placing an obstruction or excavation beyond a lot line or within a highway unless it's authorized by a permit or privilege under this section, or specifically allowed elsewhere. For uses under 90 days, the City Engineer may grant a temporary occupancy permit (per Wis. Stat. § 66.0425(7)), requiring an application, fee, and assumption of liability. For uses of 90 days or more, the Common Council may grant a 'privilege' (per Wis. Stat. § 66.0425(2)), which can require a bond up to $10,000. A few minor items, a standard USPS mailbox, or tree limbs at least 13 feet up, get a privilege automatically with no fee. Unauthorized obstructions may be summarily removed at the owner's expense.
