Durham Code Chapter 62 prohibits obstructing public sidewalks without authorization. Encroachment into the public right-of-way requires a permit from Right of Way Management.
Durham regulates sidewalk obstructions through Durham Code Chapter 62 (Streets and Sidewalks) and the Unified Development Ordinance. Property owners, businesses, and contractors may not obstruct public sidewalks without proper authorization. The UDO Section 10.2 specifically requires that parked vehicles must not obstruct sidewalks or walkways at any time. Any encroachment into the public right-of-way, including signs, merchandise displays, outdoor dining areas, construction materials, or temporary structures, requires a permit from the Durham Right of Way Management Division. Vegetation from private property must be trimmed so it does not encroach into the sidewalk path. Property owners are responsible for keeping the sidewalk area adjacent to their property clear of debris, snow, ice, and overgrown vegetation. Construction projects that temporarily close or obstruct sidewalks must provide accessible pedestrian detours and obtain encroachment permits under Chapter 62. The Durham Transportation Department enforces sidewalk accessibility requirements consistent with ADA standards. Contact the Right of Way Management Division at (919) 560-4326 for encroachment permit applications and Durham One Call at (919) 560-1200 to report obstructed sidewalks.
Obstructing a public sidewalk without a permit may result in code enforcement action. Property owners receive notice to remove the obstruction within a specified timeframe. Failure to comply may result in the city removing the obstruction at the property owner's expense and civil penalties under Durham Code Section 1-9.
