Fort Myers, FL Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

It is unlawful for any person to willfully obstruct the free, convenient and normal use of any public street, highway or road right-of-way by impeding, hindering, stifling, retarding or restraining traffic passing thereon, by soliciting, standing or approaching vehicles or pedestrians traveling thereon, or to make any commercial use of any street or highway right-of-way as defined by F.S. ch. 337.(c)Nothing in this section shall be construed to:(1)Inhibit political campaigning on public rights-of-way or require a permit for such activity.(2)Inhibit the rendering of emergency service on public rights-of-way or use of public rights-of-way by private persons in any emergency.(3)Prevent the issuance of a permit by the city to allow parades otherwise permissible on public streets.(4)Prevent the issuance of a permit by the city to allow charitable solicitors by licensed charities as defined by F.S. ch. 316.(d)The code enforcement division and the police department are each required to enforce this section by warning first time violators, and by issuing appropriate citations which thereafter may be necessary in accordance with penalties assessed by this chapter or under chapter 2, article V, pertaining to code enforcement procedures.
