Linden, NJ Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

2, added October 17, 2023 by Ordinance No. 67-66, prohibits placing goods, wares, merchandise or other articles of trade or sale on the street or sidewalk area of Linden in any way that obstructs the lawful passage of pedestrians and traffic. The section defines "street or sidewalk area" broadly, as the full width of property dedicated or used for public street purposes, including both the portion normally used for vehicular travel and the area extending from that portion to the property line on either side.

The same subsection separately bans constructing or installing a basketball backboard or pole in the City's right-of-way or in the area between the curb and the sidewalk. 2(b) carves out four exceptions: loading or unloading goods to and from vehicles for no more than fifteen minutes; garbage, ash or refuse receptacles lawfully placed for collection; building materials deposited under an active building permit and with Building Subcode Official approval of their placement; and merchandise displayed during the Linden merchants' annual "sidewalk sales days," approved by City Council.

2(c) gives the Linden Police Department authority to prevent obstructions and to remove an existing one, but only after giving the owner of the abutting premises reasonable notice to remove it first.
