Summary

Contractors working in the unincorporated county cannot block public streets, sidewalks, or private driveways during construction, remodeling, demolition, or grading. County Code requires protection for adjoining property and, when the Building Official calls for it, a six-foot screen fence around the site; blocking access can bring a stop-work order.

Full Breakdown

Santa Barbara County Code Sec. 3, Protection of Nearby Property and Persons, and Obstruction of Streets, Sidewalks, and Driveways, for the unincorporated area. 1, any construction, remodeling, demolition, or grading project must protect adjoining and nearby public and private property, including footings, foundations, party walls, chimneys, skylights, fences, walkways, and patios, and must control water runoff and erosion. Critically, the work itself cannot obstruct access to public streets or sidewalks, nor to private driveways or private property, while it is underway. 2 backs that up with a physical barrier requirement: when the Building Official calls for it, at the start of construction, remodeling, demolition, or grading, or as soon afterward as feasible, the site must get a protective screen or fence at least six feet high between the work area and the public streets, sidewalks, and adjoining properties, and this applies notwithstanding the County's separate Land Use and Development Code or Coastal Zoning Ordinance provisions.

3 gives the Building Official authority to issue a Stop Work Notice; work cannot resume until the damage is corrected, the obstruction is cleared, and the Building Official gives written approval. 4 goes further and requires County staff to suspend field inspections on the property entirely until the obstruction or damage is resolved.

Violations & Fines

Blocking a sidewalk, street, or driveway during construction can bring an immediate Stop Work Notice from the Building Official under Sec. 10-2.1.2(D) (Section 3307.3.3), and County inspectors will suspend all field inspections on the project under Section 3307.3.4 until access is restored and any property damage is repaired to the Building Official's satisfaction.

Frequently Asked Questions

Can a contractor block a public sidewalk while building in unincorporated Santa Barbara County?
No. County Code Sec. 10-2.1.2(D) bars construction, remodeling, demolition, and grading activity from obstructing access to public streets, sidewalks, or private driveways at any point during the project, not just at completion.
Does every job site need a six-foot fence?
Only when the Building Official requires one. Section 3307.3.2 gives the Building Official authority to order a protective screen or fence at least six feet high around a construction, demolition, or grading site, typically at the outset of work.
What can the County do if my project blocks the street?
The Building Official can issue a Stop Work Notice halting all activity, and County staff will suspend field inspections on the property under Section 3307.3.4 until the obstruction is cleared and written approval to resume is granted.
