Shelby, MI Sidewalk & Pedestrian Rules: Obstruction Rules (2026)

Section 430-24, Obstructions prohibited, sits in Article III, Sidewalk Maintenance, adopted January 27, 2025 by Ordinance No. 02-24B. It prohibits placing any snow, dirt, trash, goods, wares, or merchandise on Village sidewalks, and more broadly bars any way of obstructing free passageway along and over the sidewalks of the Village, unless the Council has first approved the obstruction. That approval requirement means even a temporary use, such as staging construction materials or a merchandise display in front of a business, needs Council sign-off before it can sit on the public walk; there is no administrative permit shortcut through the Village Administrator for a sidewalk obstruction the way there is for a right-of-way excavation under § 430-6.

The section works alongside § 430-25, which separately requires property owners and occupants to keep the sidewalks abutting their premises clear of papers, leaves, trash, personal property, and overgrowth, and § 430-15, which lets building operations occupy a street only if at least five feet of sidewalk remains clear for pedestrians, or a temporary plank sidewalk is provided. Together these sections give the Village multiple, overlapping tools, a general obstruction ban, an owner upkeep duty, and a construction-specific passage rule, to keep Village sidewalks passable.

Noncompliance triggers the same notice-and-abatement track as other Article III violations: the enforcing officer issues a notice to abate under § 430-27, and if the condition is not corrected the Village can remove the obstruction itself under § 430-28 and bill the responsible owner or occupant.
