Chelsea, MA Sidewalk & Pedestrian Rules: Sidewalk Repair (2026)

Chelsea places sidewalk work under two rules that split responsibility by circumstance. ' Section 24-25 then shifts the cost and duty onto private developers whenever new building or substantial renovation triggers the need for a sidewalk: any developer or contractor who constructs a new residential or commercial building, or substantially renovates an existing commercial building or a residential building of four or more units where 75 percent or more of the existing floor area is being renovated, must install a new concrete sidewalk with granite curbing along the entire perimeter of the public way abutting the property line, built to department of public works specifications.

No certificate of occupancy issues until the department of municipal inspections confirms the DPW is satisfied with the completed sidewalk. The DPW can waive replacement at its sole discretion if the existing abutting sidewalk does not need it, but in that case the developer must instead pay into the Community Improvement Trust Fund an amount equal to the cost of installing a new sidewalk along the full public way perimeter of the building, so the obligation converts to a cash payment rather than disappearing. Both the department of municipal inspections and the DPW have authority to enforce section 24-25.

Outside of new construction or major renovation, routine sidewalk repair is handled by the city's public works department rather than assigned to abutting owners by ordinance, though owners remain separately responsible for clearing snow and ice from the sidewalk in front of their property under section 24-21.
