The owner and/or occupant of the premises shall maintain the structures and exterior property in compliance with these requirements, except as otherwise provided for in the Property Maintenance Code. ... Section 21.43 of the Property Maintenance Code puts the duty on the owner and/or occupant of the premises to maintain the structures and exterior property. Section 21.97, in the same Article 7 on Exterior Property Areas, spells out the standard: sidewalks, walkways, stairs, driveways and parking spaces must be kept in a proper state of repair and free from hazardous conditions. The Building Official inspects and can issue a correction notice; if the owner or occupant fails to fix a hazardous walking surface, the case can go to the County's Special Magistrate.
