Summary
St. Charles County puts sidewalk maintenance on the adjoining property, not the county, once a subdivision sidewalk is built.
Maintenance of the sidewalk shall be the responsibility of the adjoining property and this requirement will be indicated on the final plat and subdivision restrictions. Handicap access ramps meeting Americans with Disabilities Act Accessibility Guidelines shall be required at intersections. Sidewalks shall have a transverse slope of two percent (2%) and shall be located within and one (1) foot off the right-of-way line, wherever possible. Sidewalks required along streets with no curb and gutter shall be located outside and within one (1) foot of the right-of-way line, wherever possible, and within a dedicated easement.
E. Street Lighting. Street lights may be installed by the developer. Lighting shall be designed and maintained to avoid unnecessary illumination of residential interiors. The developer shall submit to the Division of Planning and Zoning a maintenance agreement, subdivision restrictions, or other similar instrument setting forth the person, corporation, trustees, or other agency responsible for the assessment as well as the collection of monies necessary for the operation of the lighting system within the subdivision.
[1] Editor's Note—For designation of the division of planning and zoning, see ord. no. 02-204 adopted 12-23-2002 set out in ch. 132 of this code and ord. no. 03-195 adopted 12-31-2003.
Official source re-checked September 7, 2026: no newer edition of the code had been published (publisher’s edition: rev 4863880; v61 updated 2026-05-11; through 05-11-2026).
Full Breakdown
Under the county's Unified Development Ordinance subdivision standards, sidewalks required along arterial and collector streets and most public minor streets must be four inches of concrete (four feet wide in residential areas, five feet in commercial/industrial), and Section 410.330(D) puts maintenance of that sidewalk on the adjoining property. The obligation is written into the final plat and subdivision restrictions at the time the lot is created, so a title search or plat review shows whether a given parcel carries it.
Violations & Fines
The code sets the maintenance duty and records it on the plat/subdivision restrictions rather than listing a standalone fine schedule; enforcement of a specific defect runs through those recorded restrictions and the county's general nuisance/right-of-way authority.
