Summary

Spokane County's zoning code has no garage sale sign category, so a sale sign is judged under the general sign rules. Portable signs over nine square feet are prohibited, off-premises signs are prohibited unless the code specifically permits them, and no sign can stand in or hang over a public right-of-way. A violation costs $200 on a Level I notice and $500 on a Level II notice.

These county ordinances apply to unincorporated areas of Spokane County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Full Breakdown

Chapter 14.800 of the Spokane County Code never mentions garage sales, yard sales or estate sales, so a hand-lettered sale sign is tested against the general sign rules. Chapter 14.300 defines a sign as a visual communication device, visible from a right-of-way, that promotes the sale of products, goods, services or events. Section 14.804.020(1) requires a building permit for an on-premises sign, and section 14.804.040 exempts temporary banners and temporary signs "as permitted herein," real estate signs, incidental signs, political signs, bench signs and contractor signs. An incidental sign is a nonelectric information sign of four square feet or less about goods or services available on the premises, meant for the convenience of the public while on the premises.

Section 14.804.050 sets the size and type limits. It prohibits portable signs exceeding nine square feet, all portable reader boards, all portable electric signs, flashing signs, and signs attached to a vehicle or trailer parked on public or private property. A portable sign is any sign that is not permanently affixed and is designed for or capable of being moved, which describes a sandwich board or a sign on stakes. Item 11 prohibits off-premises signs in all zones unless otherwise specifically permitted. The one directional allowance in section 14.804.060 belongs to real estate: open house signs on each access street, unlit, five square feet, three feet high, and used only while the property is open for inspection. No parallel allowance names garage sales. Temporary banners, flags and pennants are a separate category under section 14.804.060(4): the division permits them for on-premises use only, for thirty days per quarter with one thirty-day renewal.

Placement rules come next. Section 14.804.110 requires every sign to leave vehicular and pedestrian accessibility and sight distance clear, to conform to the chapter 14.812 clear view triangle, and to stay out of, and not overhang, any public right-of-way. Any part of a sign between three and seven feet above grade must sit at least ten feet back from the right-of-way unless no sight-distance impact can be demonstrated. Under section 3.13.040, a sign that the county engineer or public works director determines interferes with pedestrian or vehicular movement shall be removed immediately. In residential zones, section 14.804.070 lists nameplates of five square feet or less and four feet high, plus wall and freestanding signs by use, and no sale sign.

Violations & Fines

The planning director enforces the zoning code. The county can charge a misdemeanor, punishable by up to ninety days in jail, a fine of up to $1,000, or both, with each day a separate offense, or choose the civil route instead. Civil penalties are $200 for a Level I notice and $500 for a Level II notice, plus $50 per day while the violation continues. A history of similar violations adds $200, or $500 once there are three or more.

Frequently Asked Questions

Does Spokane County require a permit for a garage sale sign?
Section 14.804.020(1) requires a building permit for an on-premises sign, and section 14.804.040 lists the exemptions. Garage sale signs are not among them by name. The exemptions that fit are an incidental sign of four square feet or less about goods on the premises, and a temporary banner allowed under section 14.804.060(4), which is limited to thirty days per quarter. A larger sign falls back to the permit rule.
Can I post a garage sale sign at the corner or along the road?
Not in the public right-of-way. Section 14.804.110(1)(c) says signs must not overhang or be located in any public right-of-way, and section 14.804.050(11) prohibits off-premises signs unless otherwise specifically permitted. The directional allowance in section 14.804.060(6)(c) covers open houses, not sales. A sign that interferes with pedestrian or vehicular movement can be ordered removed immediately under section 3.13.040 by the county engineer or public works director.
How large can a portable garage sale sign be?
Section 14.804.050(4) prohibits portable signs exceeding nine square feet, so nine square feet is the cutoff for a sandwich board or similar movable sign. A smaller sign still has to meet the location rules in section 14.804.110. Portable reader boards and portable electric signs are prohibited at any size, as are signs attached to a vehicle or trailer parked on public or private property.
What happens after a notice of investigation?
The recipient has fourteen days to respond or show proof of compliance. If none arrives, the county can issue a Level I notice at $200. A Level II notice at $500 follows if a Level I notice draws no response within fourteen days, a voluntary compliance agreement is breached, or violations repeat on the same property within an eighteen-month period.
How do I appeal a notice of violation?
File a notice of appeal with the enforcement authority within fourteen days of service of a Level I notice, or of a Level II notice issued as the first citation. A processing fee applies. The county hearing examiner holds a public hearing and Spokane County bears the burden of proof. The decision is final unless a land use petition is filed in superior court within twenty-one days under chapter 36.70C RCW.
