Miami Beach Chapter 138, Articles III and IV regulate political and election signs as a category of temporary signs. Political signs on private property are treated as free speech signs and do not require a permit. Signs must comply with the size limitations established for the applicable zoning district. In residential districts, temporary signs including political signs are generally limited in size and must not obstruct visibility at intersections or driveways. Signs cannot be placed on public property, rights-of-way, utility poles, or traffic signs. Political signs must be removed within 7 days following the election to which they relate. Abandoned political signs left beyond the removal period become violations subject to Code Compliance action. The city cannot regulate the content of political signs but may enforce reasonable time, place, and manner restrictions consistent with First Amendment protections. Illuminated political signs may trigger additional requirements under the city's outdoor lighting standards, particularly during sea turtle nesting season on beachfront properties.
Political signs not removed within 7 days after the election are subject to removal by the city and Code Compliance citations. Signs placed on public property or rights-of-way may be immediately removed. Repeat violators face escalating fines.
