Florida Statute Section 403.7033 prohibits Orlando and every other Florida municipality from regulating the use, disposition, sale, or auxiliary containers, wrappings, or disposable plastic bags pending a state legislative review that has never been completed.
FL Β§403.7033 directs the Florida Department of Environmental Protection to study the regulation of plastic bags and report to the Legislature, then bars local governments from enacting any local ordinance regulating bags until the Legislature acts on the report. The DEP report was issued in 2010 but the Legislature has not authorized local action. Florida courts have struck down attempted bans by Coral Gables and others. Orlando therefore cannot ban plastic carryout bags, impose a per-bag fee, or require paper-only checkout. The city pursues voluntary reusable bag programs and recycling outreach instead, including drop-off bins at major grocers and the Orlando Solid Waste Division.
Orlando cannot enforce any local plastic bag ban or fee. Attempts to do so face state preemption challenges under FL Β§403.7033 and likely judicial invalidation.
