California Assembly Bill 1276 bars Santa Ana takeout and delivery food sellers from including single-use utensils, condiment packets, and similar accessories unless the customer asks for them.
California Public Resources Code 42275 et seq. requires food facilities preparing food for takeout or delivery in Santa Ana to provide foodware accessories such as plastic forks, spoons, knives, chopsticks, condiment cups, lids, and napkins only when the customer asks. Online ordering platforms must offer a clearly visible opt-in. The first two violations are warnings, then fines of up to 25 dollars per day apply. Reusable foodware standards are still being phased in statewide. Customers can always request as many accessories as needed at no cost.
Defaulting to include utensil bundles in every takeout order, hiding the opt-in on a delivery app, or charging customers for accessories.
