Florida Statutes Section 163.04 provides strong protections for solar energy installations. No deed restriction, covenant, declaration, or similar binding agreement may prohibit or effectively prohibit solar collectors or other renewable energy devices from being installed on buildings. HOAs may determine the specific location where solar collectors may be installed on the roof within an orientation to the south or within 45 degrees east or west of due south, but only if such determination does not impair the effective operation of the solar collectors. Fort Lauderdale follows this state law and does not impose additional local restrictions on solar installations. The prevailing party in litigation under this section is entitled to costs and reasonable attorney's fees.
