California's Solar Rights Act (Civil Code Β§714) prohibits HOAs from banning solar panels. Any CC&R restriction that reduces system efficiency by more than 10% is void. Pine Mountain Lake and other HOA communities in Tuolumne County must comply.
California Civil Code Β§714 (Solar Rights Act) strongly protects homeowners' rights to install solar energy systems. HOAs and CC&Rs cannot prohibit solar installations, and any restriction that would decrease system efficiency by more than 10% or increase cost by more than $1,000 is void and unenforceable. This applies to communities in Tuolumne County with active HOAs, including Pine Mountain Lake Association (Groveland area) and other planned developments. HOAs may require reasonable aesthetic conditions (e.g., flush-mounted panels, equipment screening) as long as those conditions don't significantly impact system performance. The Solar Rights Act was strengthened by AB 2188 (2014) which also streamlined local permitting.
