Unlike many states, Nebraska has no law stopping a homeowners association from restricting rooftop solar. A 2024 bill to void HOA solar bans died in committee, so a Sarpy County HOA's covenants still control.
Nebraska does not protect rooftop solar from homeowners associations. A 2024 bill, LB1119, would have voided covenants that prohibit or restrict solar panels, but it died in the Judiciary Committee, so no such protection is in force. In a Sarpy County subdivision, an HOA's recorded covenants and architectural review can still limit or even bar panels, so homeowners should read their CC&Rs before signing a solar contract. Nebraska law does protect solar access in two narrower ways: neighbors can record a solar easement under Neb. Rev. Stat. 66-901, and a county or city may grant a zoning variance so an ordinance does not block solar.
An HOA enforcing a valid covenant against solar acts within its authority; disputes are civil matters under the CC&Rs. Fines vary by association.
