(C)Building permit. A building permit is required for the installation of all SES.(D)Compliance with other laws and ordinances. All SES shall comply with all federal, state and local laws and ordinances not in conflict with this subchapter, including but not limited to building codes, fire codes, placement in floodplains and historic preservation districts.(E)Compliance with Federal Aviation Agency (FAA) regulations. SES must comply with any applicable FAA regulations, including any necessary approvals for installations close to airports.(F)Signs. No signs, unless listed as exempt signs in section 154.373, shall be placed on SES structures.(G)Method of measurement. SES are measured in the following manner:(1)Area. The area of the SES shall be determined by the total surface area of all the panels located on a lot.(2)Height. The height of the SES shall be calculated as the distance from grade or roof to the top of the solar panel at its greatest incline.

St. 512 makes the entire subchapter apply to any new development or addition to an existing development anywhere in the unincorporated county. 513(A) splits systems into Building-mounted SES (roof-mounted or facade-mounted) and Ground-mounted SES, further split into small-scale (40,000 square feet of panel area or less) and large-scale (over 40,000 square feet). Building-mounted systems are an accessory use in every district; ground-mounted small-scale systems are a permitted primary use on 5-plus-acre residential lots and in the Agricultural, Commercial, Industrial and University districts, but need special-use approval from the board of zoning appeals on smaller residential lots and in the Office/Buffer, Office and Business districts.
Large-scale ground-mounted systems need a special use everywhere except Industrial and University districts, where they're an outright permitted use, and are the preferred use on brownfields, Superfund sites, parking lot canopies and former landfills. 515(B), and setbacks run from the panel edge to the property line or, near a house, to the outermost foundation of the dwelling. Large-scale arrays in agricultural districts also need a 500-foot buffer from a non-participating residence and a 150-foot buffer from a non-participating property line, waivable only by a notarized, recorded agreement. 513(H) before the building permit issues, and the installation must still clear FAA rules near airports and floodplain placement rules.
Violations & Fines
Installing an SES without the building permit § 154.513(C) requires, or exceeding the 22-foot ground-mounted height cap or required setback in § 154.515(B), is a zoning violation handled under § 154.999. The zoning administrator issues a notice of violation, and an uncorrected violation draws a citation with a fine set in the county's appendix schedule of fines and fees, due within 7 days in a business or industrial district or 14 days in an agricultural or residential district before the county attorney can sue to enforce compliance and recover attorney fees. Large-scale ground-mounted systems that are abandoned (no operation for over a year) must be physically removed within 120 days, and systems over 200,000 square feet in panel area must carry a security fund equal to 100% of removal cost.
