Summary

Clay County lets residents opt out of door-to-door sales by posting a "No Solicitors" sign, which a peddler must check for and obey before knocking. Even without a sign, soliciting at a residence is barred before 9:00 a.m. or after 9:00 p.m. on weekdays, and entirely on Sundays and certain holidays.

These county ordinances apply to unincorporated areas of Clay County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

(e)Uninvited soliciting prohibited. It is hereby declared to be unlawful and a violation of this subsection for any person to enter upon any premises upon which a residence is located and undertake to attract the attention of an occupant thereof or to engage in soliciting thereon if any nonsolicitation notice is posted or exhibited at such residence.(f)Time limit on soliciting. It is hereby declared to be unlawful and a violation of this subsection for any person to go upon any premises upon which a residence is located and undertake to attract the attention of an occupant thereof or to engage in soliciting thereon at any time prior to 9:00 a.m. or after 9:00 p.m. of any weekday, or at any time on a Sunday, July 4, December 24 or any day observed as a holiday pursuant to Section 110.117, Florida Statutes (2000).

Full Breakdown

Section 15-8 regulates residential soliciting and peddling countywide, in the unincorporated area only (15-8(i)). Before knocking or ringing a bell to "attract the attention of an occupant," a solicitor has a duty under 15-8(b) to first check whether a "nonsolicitation notice" is posted near the main entrance. Section 15-8(a)(3) defines a valid notice as any legible sign reading "No Solicitors," "No Soliciting," "No Peddlers," "Solicitation Prohibited" or similar wording. If such a sign is posted, 15-8(c) and (e) require the solicitor to immediately and peacefully leave without attempting to attract an occupant's attention; entering anyway is a violation.

Section 15-8(d) also requires a solicitor to leave immediately once any occupant asks them to, regardless of a sign. 117, Florida Statutes. Violations of the sign-defiance rule (e) or the hours rule (f) are category 1 civil infractions ($25) under 15-20(j), enforceable as a nonexclusive alternative to prosecution, with the category enhanced for repeat violations under 15-20(k). 69, Florida Statutes, punishable by up to a $500 fine and 60 days in the county jail, per 15-8(g).

Violations & Fines

Soliciting past a posted "No Solicitors" sign or outside the 9:00 a.m. to 9:00 p.m. weekday window is a category 1 civil infraction, $25 for an initial violation, escalating for repeats under section 15-20(k), or prosecutable as a second-degree misdemeanor up to $500 and 60 days in jail for habitual offenders.

Frequently Asked Questions

What wording makes a no-soliciting sign legally effective?
Section 15-8(a)(3) lists acceptable wording: "No Solicitors," "No Solicitors Allowed or Invited," "No Solicitation," "No Soliciting," "Solicitation Prohibited," "Soliciting Prohibited," "No Peddlers," "No Peddlers Allowed or Invited," "No Peddling," "Peddling Prohibited," or words of similar import, posted legibly near the main entrance and visible from it.
Can someone solicit on my porch if I don't have a sign posted?
Only within the hours in 15-8(f): 9:00 a.m. to 9:00 p.m. on weekdays, and never on a Sunday, July 4, December 24, or a holiday recognized under Section 110.117, Florida Statutes. A resident can also invoke 15-8(d) at any time by simply telling the solicitor to leave, which they must do immediately.
Does this rule cover charities and political canvassers?
Section 15-8(a)(8) defines soliciting broadly to include seeking sales, insurance customers, publication subscriptions, and gifts or contributions for any charitable or nonprofit purpose, so nonprofit canvassers must also respect posted signs and the 9:00 a.m. to 9:00 p.m. weekday window.
Is this a countywide rule or just unincorporated Clay County?
Section 15-8(i) limits the ordinance to the unincorporated area of the county. Orange Park, Green Cove Springs, Keystone Heights and Penney Farms are separate municipalities and set their own soliciting rules within their city limits.
