Full Breakdown
Iron County Code § 5.08.080(A) requires itinerant businesses, defined to include merchants, peddlers, solicitors, auctioneers, hawkers, tradesmen and home improvement contractors deemed transient by the license officer, to pay a license fee of one hundred dollars per year or any part of a year during which they operate, plus thirty-five dollars for each employee beyond one. Subsection (B) lets the license officer require applicants to disclose their business history, moral character, felony or misdemeanor convictions, and proof of the origin of their goods. Section 5.04.140(G) separately makes it unlawful for a solicitor, peddler, hawker, itinerant merchant or transient vendor to enter private residential property to solicit sales unless invited by the owner or occupant.
Section 5.08.120 adds further restrictions on 'nontransient' local peddlers: it is unlawful to peddle within one block of a school for fifteen minutes before and after school sessions or during student activities, peddling fresh or cured meat or fish is prohibited outright, and peddlers cannot display wares outside their vehicle on public streets or sidewalks.
Violations & Fines
Soliciting or peddling without paying the required license fee under Section 5.08.080, or entering private residential property to solicit without an invitation in violation of Section 5.04.140(G), exposes the violator to license denial or the general misdemeanor penalty in Section 5.04.150: a fine up to one thousand dollars, imprisonment up to six months, or both, with each day of continued violation a separate offense.
