Summary

Itinerant vendors and door-to-door solicitors in unincorporated Merced County must obtain a Sheriff's permit before going door to door, submitting fingerprints, photographs, and a full description of the goods offered, and every application undergoes a Sheriff background check into the applicant's honesty and integrity.

These county ordinances apply to unincorporated areas of Merced County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Except as provided in this chapter, it is a violation for any itinerant vendor to engage in any business in any unincorporated area of Merced County, whether for himself or as agent or employee of some other person, firm, company, corporation, association or organization, without having first procured from the sheriff a permit for such purpose. The sheriff is designated as an agent of the board of supervisors for the purpose of issuing such permit.

Full Breakdown

Chapter 6.24 of the Merced County Code requires any itinerant vendor, defined as a person with no established place of business in the county who goes door to door or sets up a temporary location to sell goods or take orders, to obtain a permit from the Sheriff before engaging in business (Section 6.24.020). The Sheriff can also require the applicant to get sign-off from planning, health, public works, the agricultural commissioner, fire, county risk management, the housing authority, and the Veterans Administration. Applicants must be at least 18, and the written application must include their name, birth date, address, a description of the goods being sold, a physical description, vehicle information, any misdemeanor or felony record, two current facial photographs, and a set of fingerprints (Section 6.24.025).

The Sheriff has 15 days to investigate the applicant's and any employer's character for morality, honesty, and integrity; if the investigation raises concerns, the Sheriff denies the permit and forwards the file to an Independent Hearing Officer appointed by the Board of Supervisors, whose ruling can be appealed to the Board within five days (Section 6.24.040, 6.24.070). Non-profit organizations skip the vendor permit but still need a non-profit permit backed by their tax-exempt status, board list, and solicitor roster, requested at least seven days before soliciting, with all fees and fingerprinting waived (Section 6.24.045).

Veterans are exempt from fees but must still obtain a permit. Permits must be displayed on the solicitor's person at all times, renew annually between January 1 and January 31, and the ordinance bars vending on the public highway or road right-of-way and in any area prohibited by the Title 18 zoning code (Sections 6.24.060, 6.24.080, 6.24.090).

Violations & Fines

Violating any provision of Chapter 6.24, including soliciting without a permit, failing to display it on demand, or vending in a prohibited right-of-way area, is charged as an infraction under Section 6.24.100 and cited by the Sheriff or any of the referenced county departments, with penalties set under Section 1.28.030 of the Merced County Code; the Sheriff can also suspend a permit for failing to report a change of circumstances within seven days.

Frequently Asked Questions

Do door-to-door salespeople need a permit in unincorporated Merced County?
Yes. Section 6.24.020 requires any itinerant vendor without an established place of business in the county to get a permit from the Sheriff before going door to door or setting up a temporary sales location, and the Sheriff can loop in other county departments to review the application.
What information does a Merced County solicitor permit application require?
Section 6.24.025 requires the applicant's name, birth date, address, physical description, a description of the goods or services offered, vehicle details, any criminal record, two facial photographs, and a set of fingerprints, all submitted under penalty of perjury to the Sheriff.
Are charities exempt from Merced County's solicitor permit?
Non-profit organizations do not need the standard itinerant vendor permit but must still obtain a non-profit permit under Section 6.24.045 by presenting proof of tax-exempt status, a board list, and a roster of solicitors at least seven days before soliciting; fees and fingerprinting are waived.
Can a solicitor sell from the road shoulder in Merced County?
No. Section 6.24.090 bars using a permit to vend on the public highway or road right-of-way and prohibits any location where the activity is barred under Title 18 of the Merced County zoning code, and doing so is a violation subject to infraction penalties.
