Full Breakdown
Horry County Code § 12.5-51 requires every person engaged in the calling of hawker or peddler within the unincorporated county to pay an annual license fee and obtain a license before conducting business, issued through the clerk of court under § 12.5-59(b). The first-year license fee was set at $500 under § 12.5-54(d), with the county council empowered to revise the fee by resolution in later years, and licenses expire December 31 regardless of when issued during the year under § 12.5-53. Registration under § 12.5-55 requires the business's Social Security or federal ID number and sworn certification that county taxes are paid.
The license must be displayed conspicuously at a fixed business location, or carried on the person of a transient peddler, under § 12.5-58, and a change of address must be reported to the license inspector within two days or the license becomes invalid. The license inspector, the county finance director's office, can deny an application for a false statement or if the activity is itself a public nuisance under § 12.5-63, and can suspend or revoke a license for breaching conditions or moral-turpitude convictions under § 12.5-64, with a right to appeal to county council within ten days under § 12.5-65. Vendors of perishable agricultural produce and charity-managed festival vendors in pedestrian-only areas are exempt under § 12.5-68.
Violations & Fines
Peddling without the required license, or operating under a false application, is a misdemeanor under § 12.5-67, punishable by up to a $200 fine, up to 30 days in jail, or both, with each day of continued violation counted as a separate offense. Fines and jail time do not excuse the offender from also owing any delinquent license fees, which accrue a 50 percent late penalty per day past due under § 12.5-61, and an unpaid fee outstanding 60 days becomes a lien on the licensee's property.
