Summary
Waukesha County requires a license from the county clerk before anyone organizes, promotes or advertises an assembly of 1,000 or more people expected to last 18 or more consecutive hours, on public or private land. Applications are due at least 30 days ahead and cover crowd caps, water, toilets and medical plans.
No person shall permit, maintain, promote, conduct, advertise, act as entrepreneur, undertake, organize, manage or sell or give tickets to an actual or reasonably anticipated assembly of one thousand (1,000) or more people that will continue or can reasonably be expected to continue for eighteen (18) or more consecutive hours, whether on public or private property, unless a license to hold the assembly has first been issued by the county clerk.
Full Breakdown
Article XVI, Division 2 of the county code (Sec. 14-760) makes it unlawful to "permit, maintain, promote, conduct, advertise, act as entrepreneur, undertake, organize, manage or sell or give tickets to" an actual or reasonably anticipated assembly of 1,000 or more people continuing 18 or more consecutive hours without a license first issued by the county clerk. A separate license is required for each day and each location where that crowd size is expected. Sec. 14-762 requires the written application at least 30 days in advance, sworn to by the organizer (or all officers/partners for an entity), disclosing the property's legal description and owner, the purpose and duration of the event, the maximum number the organizer will permit to assemble, ticket caps, and detailed plans for potable water, toilet and lavatory facilities, solid waste disposal and medical facilities.
Sec. 14-761 limits any license to the maximum crowd stated on it and bars sound from carrying "unreasonably beyond the enclosed boundaries" of the site. Two exemptions matter: Sec. 14-752 exempts established permanent venues (places of worship, stadiums, arenas, auditoriums) unless the crowd exceeds the structure's normal seating capacity by more than 250, and exempts government-sponsored fairs on established fairgrounds. This licensing scheme was adopted to keep large, extended gatherings from overwhelming the county's health, fire, police, transportation and utility services, per the stated purpose in Sec.
14-751. Because the trigger is 1,000+ people continuing 18+ consecutive hours, most short town parades or block parties fall outside this license, but any large festival, concert or multi-day gathering meeting that threshold must obtain it from the county clerk before advertising or selling tickets.
Violations & Fines
Sec. 14-753 makes violating this article, or any condition of a license, punishable by a forfeiture of not less than $1,000 nor more than $10,000, with each day a violation continues counted as a separate offense. The county board may also enforce the article by injunction in any court of competent jurisdiction, and an unlicensed qualifying assembly is declared a public nuisance that may be abated as such.
