Full Breakdown
Under Chapter 17 of the Charter Township of Royal Oak Code, a permit is the written permission that must be obtained from the director or his designated agent to carry out a given activity in a park (§ 17-31). The director heads the township's department of recreation. The Township does not use one blanket event permit. It attaches permit requirements to particular activities.
Group gatherings. Section 17-39 bars bringing in, consuming or selling alcoholic beverages in a park, with two exceptions. Persons operating under a concession from the township can sell alcohol, subject to the regulation and control of the director. And alcoholic beverages can be consumed at family or group picnics or functions, provided a permit for that consumption is obtained. A group function with drinks needs the permit in hand before anyone opens a cooler.
Picnic areas. Under § 17-38, the director designates the areas of a park where picnicking is permitted, and no person can picnic outside a designated area. Picnickers cannot leave until all boxes, papers, cans, bottles, garbage and other refuse is removed from the park or placed in a disposal receptacle.
Vending and stands. Section 17-45 prohibits exposing or offering for sale or hire any article, thing or service, and prohibits placing any stand, cart or vehicle for the transportation, sale or display of any article, thing or service, unless a permit has been obtained from the director. Signs, placards and advertisements go up only under regulations the director promulgates.
After-hours events. The park curfew in § 17-35 runs from dusk to dawn, but a special permit from the Recreation Department or a scheduled Recreation Department activity lifts it. Section 17-44(f) separately requires a permit from the director for any vehicle left on park property after park closing hours.
Violations & Fines
Violating any provision of Chapter 17, Article II, including acting without a required permit, is a municipal civil infraction with a fine of not less than $100.00 or more than $500.00 under § 17-33. Under § 17-34, a violator can also be ejected, have the permit confiscated and lose park privileges for a period the director sets. Police agencies, ordinance officers and park rangers can issue the tickets under § 17-47.
