(b)Outdoor seating area. Outdoor seating areas, plazas, or courtyards are permitted at the ground level between the building and property line provided that the area:(1)Does not interfere with pedestrian access or parking areas;(2)Is not located in a required yard that abuts a residential district;(3)If adjoining the public sidewalk:a.Maintains a distinct delineation between the right-of-way line and the outdoor area through the use of hardscape and architectural elements such as a masonry wall, fence, plants, or bollards. These elements may establish the front or corner side building line if:1.They are an appropriate height and type, and meet section 33-6.8.3.4, Openings, as determined during site plan review; and2.The building façade also meets the standards of section 33-6.8.3.4, Openings.b.A nonresidential use may have its principal entrance oriented to the outdoor seating area if accessible to pedestrians from the adjoining public sidewalk;(4)Is constructed of a durable outdoor surface;(5)Shall not be:a.Wider than fifty (50) linear feet or fifty (50) percent of the development site's width, whichever is less;b.Set back more than twenty-five (25) feet from the required build-to-line or setback; and(6)Is accessory to a principal use.
