Restaurants and businesses in Buckeye, Arizona that want tables, chairs, umbrellas, benches or planters on the public sidewalk need a sidewalk furniture encroachment permit, a Class 2 permit, under City Code §§ 19-4-1 through 19-4-4. The permit only covers sidewalks next to commercial retail property (bus shelters and bike racks are excepted). Furniture must stay movable, keep a 6-foot clear path parallel to storefronts plus a 6-foot access way to the street and parking, and none of it can be used to serve or consume alcoholic beverages in the right-of-way. Applicants sign an indemnification agreement, carry insurance, and pay a nonrefundable processing fee; the city can approve, conditionally approve, or deny each application.
