Summary

Prince George's County's Zoning Ordinance lets restaurants add or expand outdoor dining without meeting standard setback, build-to-line, or parking minimums, but any dining space added after April 1, 2024 must still appear on an approved site plan reviewed through DPIE's expedited process.

These county ordinances apply to unincorporated areas of Prince George's County. Incorporated cities within the county may have their own rules that take precedence over county-level regulations.

Any Eating or Drinking Establishment Use. Outdoor Dining. Regulations. Any establishment that added or expanded outdoor dining pursuant to temporary authorization for outdoor seating provisions during the Covid-19 health crisis prior to April 1, 2024 shall remain exempt from provisions concerning site plan conformance, minimum setbacks, and minimum parking and shall not be subject to violation or enforcement action so long as the establishment remains in compliance with the requirements of this Subsection. Any establishment providing or expanding outdoor dining after April 1, 2024 shall be subject to provisions concerning site plan conformance and shall reflect the location and other details of proposed outdoor dining on all applicable site plans, but shall not be subject to minimum building setbacks or build-to lines, or minimum parking requirements, so long as the establishment remains in compliance with the requirements of this Subsection... The DPIE Director shall establish and administer an expedited administrative process to authorize otherwise existing lawful uses in the Eating and Drinking Establishment Uses Principal Use Category on adjacent exterior space or shared exterior space in Prince George's County.

Full Breakdown

Section 27-5102(e)(5) of Subtitle 27, the Zoning Ordinance, carries forward the outdoor dining rules the County first adopted for COVID-19 recovery and folds them into permanent use-specific standards for Eating or Drinking Establishment Uses. Outdoor seating added or expanded under the earlier temporary authorization before April 1, 2024 stays exempt from site plan conformance, minimum setbacks, and minimum parking, and the County will not bring a violation or enforcement action against it as long as the establishment keeps complying with the Subsection. Outdoor dining created or expanded after that date is treated differently: it must comply with site plan conformance and appear on all applicable site plans showing its location and other details, but it still is not subject to minimum building setbacks, build-to lines, or minimum parking requirements.

Any establishment relying on either track still has to follow every other applicable State and County law. The DPIE Director runs an expedited administrative process so existing lawful eating and drinking establishments can get authorization for new or expanded outdoor seating on adjacent or shared exterior space without going through a full site plan amendment. The County keeps real teeth behind that convenience: it can rescind an outdoor dining approval immediately, without a grace period, if the establishment falls out of compliance with any State or County law or with the requirements of this Subsection, and County law enforcement can assist DPIE with enforcement.

Violations & Fines

An establishment that adds outdoor dining without going through DPIE's expedited authorization, or that lets a covered outdoor seating area fall out of compliance with Section 27-5102(e)(5), risks immediate rescission of its outdoor dining approval, with no grace period required. Continued unauthorized use can also draw a standard Subtitle 27 zoning violation notice and, under Section 27-8206, a misdemeanor fine of up to $500 or 90 days in jail.

Frequently Asked Questions

Do PG County restaurants need a variance to add a patio?
No. Section 27-5102(e)(5) exempts outdoor dining space from the Zoning Ordinance's minimum building setbacks, build-to lines, and minimum parking requirements, whether it was added before or after April 1, 2024.
Does new outdoor dining still need to go on a site plan?
Yes, if it was added after April 1, 2024. It must comply with site plan conformance and show the location and details of the outdoor dining on all applicable site plans, even though setback and parking minimums do not apply.
Can the County take away an outdoor dining approval?
Yes, immediately. The Ordinance lets the County rescind an outdoor dining approval without a grace period for failure to comply with any State or County law or with the Subsection's requirements.
Who approves new outdoor seating requests?
The DPIE Director administers an expedited administrative process for existing lawful Eating or Drinking Establishment uses seeking to add or expand outdoor dining on adjacent or shared exterior space.
