A permit issued by the City Council pursuant to this section shall not be required for structures used for outdoor dining on a public sidewalk or other public way, provided the restaurant/applicant has obtained all city required approvals including, but not limited to, written approval from the City Building Inspector.
C. Violations; penalty. The City may immediately remove, at the expense of the owner, any sign or structure found to be in violation of this section. Additionally, any person found to be in violation of this section shall also be subject to a fine, as provided in § 2-1025. However, pursuant to M.G.L. c. 85 § 8, no fine shall issue unless the person fails to remove the structure or cure the violation after being given five days' notice to do so.
D. Licensing period. A permit issued under the provisions of this article is revocable and shall be valid for the period of time allowed by the permitting authority.
