Mount Vernon, NY Special Events & Permits: Sidewalk Dining & Cafés (2026)

Section 227-50.1 requires any retail or other establishment to get a City Clerk permit before using public walk, street or alley space as a sidewalk cafe. The application must name the operator, describe the location and table/chair layout, state hours of operation, and win sign-off from the Commissioners of Public Safety, Public Works and Buildings (§ 227-50.3B). Applicants must carry $1,000,000 combined liability and property damage insurance naming the City as additional insured, file an indemnity agreement, and submit a site plan showing furniture, lighting and outlet locations (§ 227-50.3C-E).

Standards limit cafes to business districts, require four feet of clear sidewalk outside the cafe footprint, restrict corner locations within 20 feet of the building line, ban umbrellas, and require removable, non-bench-like barriers low enough for police to see into the cafe (§ 227-50.4). Operating hours run 8 a.m. to 8 p.m., May 1 through October 31 only, alcohol is flatly prohibited, food can only be served to seated patrons who pay inside, and the area must stay clean (§ 227-50.5). Four City commissioners share inspection duty (§ 227-50.6), and the City Clerk can revoke a permit on 10 days' written notice and a hearing (§ 227-50.7).
