Full Breakdown

Shelby restaurants that hold a sidewalk cafe permit under City Code Ch. 10, Art. III otherwise must set up and remove outdoor furniture, but Sec. 10-132(4) lets the city manager approve permanent, year-round placement of tables, chairs, umbrellas and planters instead. The furniture must stay movable, umbrellas need a 60-pound base, and the permittee must keep the sidewalk clear of litter, debris, leaves, acorns and food or drink stains at all times. No materials can be stored on the sidewalk or in the public right-of-way, and the permit itself can be revoked or suspended by the city manager for any violation.

Violations & Fines

Violating the year-round furniture standards, leaving trash or stored materials on the sidewalk, or breaching any permit condition lets the city manager revoke or suspend the sidewalk cafe permit at any time.
