Sparks, NV Special Events & Permits: Sidewalk Dining & Cafés (2026)

Chapter 5.77 of the Sparks Municipal Code governs sidewalk cafes. Section 5.77.030 requires both an outdoor services permit and an encroachment permit before any restaurant or bar can seat customers or serve food or drinks on a sidewalk or public right-of-way, though the chapter does not apply to outdoor service authorized under a Chapter 9.34 special event permit. The outdoor service area must sit immediately adjacent to, or within ten feet of, the indoor restaurant or bar it serves, and cannot be placed where vehicle speed, volume or proximity make sidewalk seating unsafe (Section 5.77.040).

Section 5.77.050 requires at least eight consecutive feet of clear, unimpeded sidewalk width at every point once the outdoor area is set up. Alcohol service is restricted to on-premises consumption within a physically barriered outdoor area (planters or fences, not attached to public property without city manager approval), the operator must post a notice that carrying an open container outside that area is unlawful, and the business must hold a valid alcohol license; a violation of these alcohol rules can be grounds for revoking the liquor license itself (Section 5.77.060).

Outdoor cafes may only operate between 7:00 a.m. and 11:00 p.m. (Section 5.77.080), and the city manager can order a temporary closure for festivals, parades, street repairs or emergencies, with advance written notice to the permittee where possible (Section 5.77.090). Health rules bar preset table settings, busing stations or trash storage outside the building and require restrooms in the adjoining indoor space (Section 5.77.070). The city council issues the outdoor service permit itself, and the city manager or designee issues the required encroachment permit, conditioned on a hold-harmless agreement, insurance, and restoring the sidewalk's appearance when the use ends (Section 5.77.100).
