(a) The issuance of a special event permit confers upon the permit holder or event organizer the right to control and regulate the sale of services, goods, food, and beverages within the special event venue in accordance with the terms and conditions of the special event permit. (b) It is unlawful for any person to sell, resell, or offer to sell or resell, any goods, food, or beverages in a special event venue except for authorized special event vendors and vendors under city contract.

010(17) lists a 'fair' and 'festival' among the activities defined as a special event when held on public property or rights-of-way, or when a privately held event still affects public use nearby. 260(a) gives the special event permit holder or event organizer the right to control and regulate the sale of services, goods, food, and beverages within the event venue under the permit's terms. 260(b) then makes it unlawful for anyone to sell, resell, or offer to sell or resell goods, food, or beverages in the venue except authorized special event vendors and vendors under city contract.

Violations & Fines
Selling or offering to sell goods, food, or beverages at a Kirkland fair or festival without vendor authorization violates 19.24.260(b) and, like other breaches of Chapter 19.24, is a civil infraction under 19.24.310 punishable by a $250 fine per violation, with each day a separate offense. The event organizer is also liable to the city for costs incurred from the violation and cannot obtain a future special event permit while those costs remain unpaid. A breach of the alcohol service conditions in 19.24.175 is separately grounds for immediate permit revocation.
