Arkansas Local Minimum Wage Preemption Law

Arkansas Code 11-4-203 establishes that the regulation of wages and employer-employee relationships is a matter of state concern, prohibiting political subdivisions from enacting their own minimum wage laws. The Arkansas Minimum Wage Act sets a uniform state minimum wage applicable to most employers with four or more employees. Cities and counties may not require higher wages, predictable scheduling, or different wage-payment timing. Local ordinances setting higher minimum wages are void; aggrieved employers may seek declaratory and injunctive relief against the political subdivision.
