Delaware Consumer Fireworks Law and Restrictions

Under 16 Del. C. Chapter 71, Delaware bans most consumer fireworks. Only ground-based or handheld sparkling devices, novelties, and toy caps are permitted, and only on June 28 through July 8, December 31, and the Chinese New Year period. Aerial devices, firecrackers, bottle rockets, and Roman candles remain illegal year-round. Public displays require a permit from the State Fire Marshal and use of a licensed pyrotechnician. The statute applies uniformly statewide; municipalities and counties cannot authorize fireworks the state prohibits, though they may impose additional restrictions on permitted sparkling devices.

Possession or use of prohibited fireworks is a misdemeanor punishable by fines up to $500 and confiscation. Unlicensed sale or display violations carry stronger penalties under the State Fire Marshal's enforcement.
