Delaware Plastic Straw Upon Request Rules

Delaware has not enacted a statewide plastic straw ban comparable to its plastic bag and polystyrene laws. Food establishments are encouraged to provide single-use plastic straws only upon customer request. Some municipalities and businesses voluntarily adopt upon-request policies, and Department of Natural Resources and Environmental Control programs promote alternatives. Accessibility law requires that flexible straws remain available for individuals with disabilities who need them.

There is no statewide penalty for distributing plastic straws, but local ordinances or voluntary commitments may carry administrative consequences.
