Hawaii State Building Code Pool Barrier Requirements

HRS Chapter 107 establishes the State Building Code Council, which adopts amendments to the International Building Code and International Residential Code that counties must adopt as a baseline. IRC Appendix G mandates pool enclosures at least 48 inches high, gate latches at minimum 54 inches, and openings no wider than four inches. Counties may adopt stricter rules but cannot fall below the state minimum. The rules apply to all residential pools deeper than 24 inches, including spas where required.

County code enforcement issues notices of violation with daily fines (typically $100-$500 per day) until barriers are corrected; civil liability if unfenced pool causes injury or drowning.
