Indiana Open Burning Air Pollution Rules

326 IAC 4-1-1 generally prohibits open burning of materials in Indiana to protect air quality. Exemptions include recreational campfires under 3 feet wide, ceremonial fires, agricultural vegetation burning, clean wood waste from on-site clearing, and certain training exercises. Burning of trash, leaves in incorporated areas with collection, tires, treated wood, plastics, and construction debris is prohibited statewide. The Indiana Department of Environmental Management (IDEM) enforces these rules. Counties and municipalities may adopt stricter ordinances and burn bans during dry conditions. Burning must not create nuisance or visibility hazards on roadways.

Violations may result in IDEM civil penalties up to $25,000 per day under IC 13-30-4. Local fire officials may issue stop-work orders. Fires endangering property may trigger arson or reckless burning charges.
