Louisiana Statewide Stormwater Discharge Permit Program

Under the Louisiana Pollutant Discharge Elimination System (LPDES), construction activities that disturb one acre or more, or are part of a larger common plan disturbing one acre, must obtain coverage under the LPDES Construction General Permit before earth-disturbing activity begins. Operators must prepare a Stormwater Pollution Prevention Plan (SWPPP), install best management practices for sediment and erosion control, conduct routine inspections, and file a Notice of Termination upon stabilization. Industrial facilities in regulated SIC categories require Multi-Sector General Permit coverage. LDEQ inspects sites and issues compliance orders. Local stormwater ordinances may add requirements but cannot waive LPDES coverage.

Discharging without LPDES coverage, failing to maintain a SWPPP, or violating effluent limits can trigger LDEQ administrative orders and civil penalties up to $32,500 per day per violation under R.S. 30:2025.
